"The Town of Brant has a law that prohibits landfills and we are not changing the law."
This was the statement Supervisor Samuel Chiavetta Jr. issued to over 60 residents at the Brant Town Board meeting Tuesday, Dec. 12.
At the July board meeting Robert A. Gerhard III of Derby gave a presentation on creating a solid waste management facility on about 1,000 acres of industrially zoned land on Cain Road by Hammond Road.
Gerhard requested that the board members consider changing a law that prohibits privately owned landfills.
At its September meeting the board unanimously agreed to not consider changing the law to accommodate Gerhard's request.
Since then residents on both sides of the issue along with others who just want more information have bombarded the board members with requests and threats.
The board has continued to stand firm on its resolution that the law would not be changed and unless there was an overwhelming majority of residents in favor of the landfill there would be no change, Chiavetta had said in November.
In a show of support for the stand taken by the board members, a petetion against the landfill with 755 signatures was submitted to the board. There are approximately 1,390 registered voters in Brant.
"We had to do something to support our Town Board," said Betty O'Donnell, who has been the prime organizer of the Friends and Neighbors Against the Brant Garbage Landfill.
"It's important that we take a stand against this. It's important to the future of Brant and Western New York," O'Donnell said.
In other business, the board in a 3-to-2 vote granted a special use permit to Joe Reynolds for a used car lot on Route 20, to be reviewed in four months.
"I can't vote for this at this point because I had to step over a transmission and a rear axel to get to your house. But I will come down to your place with a truck and help you clean up." said Council Member Martin Rosiek.
Council Member Dennis Rubeck also voted against the special use permit because of Reynolds past history on the property and said he is not confident that he will follow through on the permits specifications.
In other action, the board:
Passed a resolution supporting the Village of Farnham "Home Rule" request to abolish the
Farnham Justice Court.
Set the organizational meeting for Tuesday Jan. 2 at 7 p.m. at the Town Hall.
The next regular scheduled meeting is Tuesday Jan. 9 at 8 p.m. at the Town Hall.
